Privacy Policy
This Privacy Policy describes how Perchy, LLC (“Perchy,” “Company,” “we,” “us,” or “our”) collects, uses, and discloses information when you use Rubii World — including the Android application, the website at rubiiworld.ai, and related services that link to this Policy (collectively, the “Services”).
We use personal data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this Policy. Undefined capitalized terms have the meanings in our Terms of Service.
If you live in the European Economic Area, the United Kingdom, or certain U.S. states, additional rights are described below.
1. Who we are
The data controller (and, where applicable, the organization responsible under other privacy laws) is:
Perchy, LLC
131 Continental Dr, Suite 305
Newark, DE 19713
United States
Privacy and support contact: [email protected]
2. Information we collect
The types of information we collect depend on how you use the Services. We need certain information to provide the Services. If you do not provide it, or if you ask us to delete it, you may no longer be able to use some or all features.
2.1 Information you provide
You may provide information when you create an Account, use the Services, communicate with us, or participate in promotions or community features. This may include:
- Identifiers, such as name, email address, display name, or username;
- Account credentials and profile information;
- Demographic information, such as date of birth or general location, if you choose to provide it;
- Your Content, such as chat messages, character descriptions, images you upload, biography text, and other materials you submit;
- Commercial information, such as purchase and subscription history;
- Payment-related information processed by Google Play or other payment processors (we do not store full payment card numbers); and
- Contents of communications with us, such as support emails.
2.2 Information collected automatically
We and our service providers may collect information about your use of the Services using SDKs, cookies, and similar technologies, including:
- Device and technical data (device type, OS version, browser type, IP address, mobile advertising or instance identifiers such as Android advertising ID, app version);
- Usage data (pages or screens viewed, features used, timestamps, referring/exit paths, crash and diagnostic logs, and identifiers such as user ID, chat ID, or session ID); and
- Approximate geolocation derived from IP address. We do not collect precise GPS location unless you later grant that permission for a specific feature.
2.3 Information from third parties
If you sign in with a third-party account such as Google, we receive information that provider shares with us according to your permissions, typically including your name and email address. Connecting a third-party account is optional. You can revoke access through that provider’s settings.
We may also receive limited information from advertising or analytics partners about how you interacted with our ads or listings (for example on Google, YouTube, or social platforms), such as campaign identifiers and approximate demographics.
2.4 Permissions on Android
With your permission, the Application may access photos or media so you can upload images (for example a profile picture or character avatar). You can withdraw permission in your device settings. We do not require access to your contacts, precise location, microphone, or camera to use core chat features.
3. How we use information
We use information to:
- provide, operate, secure, and administer the Services;
- create and manage your Account and authenticate you;
- generate AI responses and other features you request;
- personalize the Services and remember your preferences;
- process purchases and subscriptions through Google Play;
- communicate with you about the Services, including support, safety, and material changes to terms or this Policy;
- send service or, where permitted, marketing communications (you may unsubscribe from marketing emails);
- analyze, maintain, improve, and develop the Services, including debugging and quality measurement;
- detect, prevent, and investigate fraud, abuse, security incidents, and violations of our Terms or Content Rules;
- comply with law, legal process, and platform requirements (including Google Play); and
- protect the rights, safety, and property of Perchy, our users, and the public.
We may combine information from different sources. We may also aggregate or de-identify information and use it for research, analytics, and improvement. We will not attempt to re-identify de-identified data except to confirm that it is de-identified.
Where we use information to train or improve our own systems, we do so in a manner designed not to include your information in public models in identifiable form. Third-party AI model providers process prompts and related content as needed to generate outputs, under their terms and our agreements with them.
4. Legal bases (EEA / UK)
If the GDPR or UK GDPR applies, we process personal data on these bases:
- Contract — to provide the Services you request and to manage your Account;
- Legitimate interests — to secure, improve, and market the Services, prevent abuse, and understand usage, where those interests are not overridden by your rights;
- Consent — where we ask for it (for example certain optional permissions or marketing), which you may withdraw at any time; and
- Legal obligation — to comply with applicable law.
5. When we disclose information
We may disclose information:
- Service providers who process data on our behalf, such as cloud hosting, analytics, crash reporting, customer support, content moderation, email delivery, and payment processing (including Google Play / Google Payments);
- AI model providers that generate responses from the prompts and context you submit;
- Other users, when you make Content or characters public or otherwise share them through the Services;
- Safety and legal, if we believe in good faith disclosure is necessary to comply with law or legal process, enforce our Terms or Content Rules, or protect the rights, safety, or property of Perchy, users, or the public;
- Business transfers, in connection with a merger, acquisition, financing, reorganization, or sale of assets; and
- With your direction or consent.
We do not sell your personal information for money. We also do not share personal information for cross-context behavioral advertising in a way that we treat as a “sale” or “share” under the CCPA, except to the extent a disclosure to an analytics or advertising SDK could be interpreted that way. You may opt out of targeted advertising and sale/share as described in Section 8.
6. Retention
We keep personal data only as long as needed for the purposes described in this Policy, including to provide the Services, comply with law, resolve disputes, and enforce agreements. Retention periods depend on the type of data, why we collected it, and your choices.
Account data is generally kept for the life of the Account. After you delete your Account, we delete or de-identify personal data from active systems within a reasonable period, typically within 30 days, except where we must retain information longer (for example backups for a limited time, legal holds, fraud prevention, tax and accounting, or safety investigations). Usage and diagnostic logs are generally retained for shorter periods unless needed for security or legal reasons.
If you create a character that is made available to other users, we may preserve that character’s non-personal characteristics so other users’ experience is not disrupted. Please do not put personal information in public character descriptions.
7. How to delete your data
You can request deletion of your Account and personal data:
- in the Application, through account or settings controls when available; or
- by following the instructions on our Delete Account page; or
- by emailing [email protected] from the email address associated with your Account.
We will verify your request and then delete personal data from active systems as described above. Some information may be retained if required by law or for legitimate business purposes such as security and fraud prevention. Deleting your Account permanently removes access to your chats, characters, purchases record in-app, and other Account data we are not required to keep.
8. Your choices and rights
8.1 Account and communications
You may update certain profile information in the Application. You may unsubscribe from marketing emails using the link in those emails. We may still send transactional or administrative messages.
8.2 Device permissions and advertising ID
You can revoke Android permissions in system settings. You can reset or opt out of personalized ads via your Google advertising settings and Android advertising ID controls.
8.3 Privacy rights
Depending on where you live, you may have the right to:
- request access to, or a copy of, personal data we hold about you (including in a portable format);
- request correction or deletion;
- object to or restrict certain processing;
- withdraw consent where processing is based on consent;
- opt out of targeted advertising, or of “sale” or “sharing” of personal information as those terms are defined under U.S. state law; and
- not be discriminated against for exercising these rights.
To exercise these rights, email [email protected]. We may need to verify your identity. You may use an authorized agent where the law allows, subject to verification. If we deny your request, you may appeal by replying to our decision email. EEA/UK users may also lodge a complaint with their local supervisory authority.
We do not use your personal data for solely automated decisions that produce legal or similarly significant effects about you, other than routine fraud and abuse prevention.
9. Children’s privacy
The Services are not directed to children under 13, or under 16 in the EEA/UK. We do not knowingly collect personal information from children below those ages. If we learn that we have, we will delete it and may restrict or terminate the associated Account. Contact [email protected] if you believe a child has provided personal information.
10. International transfers
Perchy, LLC is based in the United States. If you access the Services from another country, your information may be processed in the United States and other countries where we or our providers operate. Those countries may have different data-protection laws than your own. Where required, we use appropriate safeguards for cross-border transfers, such as standard contractual clauses.
11. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal data. No method of transmission or storage is 100% secure. We cannot guarantee absolute security.
12. Third-party links
The Services may link to third-party sites or services. Their practices are governed by their own policies, not this one. Please read those policies before providing information to them.
13. Do Not Track
Some browsers offer a “Do Not Track” signal. There is no common industry standard for responding to it. The Services do not currently respond to DNT signals. We honor legally required opt-out preference signals where applicable, such as the Global Privacy Control, for sale/share / targeted advertising opt-outs.
14. Changes to this Policy
We may update this Policy from time to time. We will post the updated Policy on this page and change the “Last updated” date. For material changes, we will provide additional notice as required by law. Continued use of the Services after an update means you have read the latest Policy.
